A first and second offense DWI in Louisiana are considered misdemeanors and are punishable up to six months in the Parish Jail. Under certain circumstances (blood alcohol level over 0.15 percent), a person charged with first or second offense DWI may face a mandatory jail sentence, and he or she will need an attorney to prevent the mandatory jail sentence from being instituted. A person convicted of a third offense DWI faces a minimum of one year in jail and a maximum of five years in jail. A person convicted of a fourth offense DWI faces a minimum of two years in jail and a maximum of thirty years in jail. As you can see, penalties for third and fourth DWI offenses are severe.
